Terms of Use

These Terms of Use govern your access to and use of WorkGateIQ, a safety decision-support product within UxAi-ClarityForge®, operated by EdenTouch CoLab Ltd (Company No. 16472666, England and Wales). By accessing or using WorkGateIQ, you agree to be bound by these Terms.

• WorkGateIQ is a decision-support tool — it does not provide legal advice
• It does not replace certified safety professionals, competent supervisors, regulators, or company safety systems
• The user organisation remains responsible for safe systems of work
• WorkGateIQ produces PASS, REFINE, or FAIL outputs based on structured inputs — these are decision-support indicators only
• Gate outputs support readiness review but do not independently authorise work
• High-risk work must always be reviewed by competent personnel before proceeding
• WorkGateIQ is currently operating as a Pilot v1.0 product

WorkGateIQ produces decision outputs (PASS, REFINE, FAIL) based on the inputs provided by your organisation's users. These outputs are decision-support indicators only. They do not constitute a legal authorisation to proceed with work. The final authority to permit or stop any work activity rests entirely with the responsible, competent person named in the Safety Gate record and with your organisation's designated safety authority.

EdenTouch CoLab Ltd accepts no liability for accidents, incidents, injuries, fatalities, or regulatory penalties arising from decisions made on the basis of WorkGateIQ outputs.

• Provide accurate, complete, and honest information when creating Safety Gate records
• Designate only genuinely competent and authorised persons as responsible persons within the system
• Use the system as a supplement to — not a replacement for — your existing safety management system, PTW procedures, and regulatory compliance obligations
• Users must verify that information entered into the system is accurate
• Maintain all applicable statutory requirements under UK health and safety legislation
• Not misuse, reverse-engineer, or attempt to circumvent the decision engine or audit trail mechanisms
• Keep login credentials secure and notify us immediately of any unauthorised access

WorkGateIQ and the underlying UxAi-ClarityForge® methodology are the intellectual property of EdenTouch CoLab Ltd. The WorkGateIQ decision engine, Control Library, and gate framework are proprietary. You may not copy, reproduce, or distribute any part of the system without written permission. UxAi-ClarityForge® is a registered UK trade mark of EdenTouch CoLab Ltd (No. UK00004246639).

Your organisation retains full ownership of all data entered into WorkGateIQ — including Safety Gate records, project data, personnel records, and decision histories. EdenTouch CoLab Ltd acts as a data processor for this data. You may request export of your data at any time by contacting us.

To the maximum extent permitted by applicable law, EdenTouch CoLab Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of WorkGateIQ. Our total aggregate liability shall not exceed the fees paid by you in the 3 months preceding any claim.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
